It is this latter category that challenges the foundations of legal accountability.
Huang Meng, a graduate researcher at East China University of Political Science and Law, has contributed significantly to this conversation through her recent publication in Science Technology and Law Review. Her work delves into the nuanced implications of granting legal personhood to advanced AI systems, particularly those exhibiting behaviors indistinguishable from human cognition.
The idea of machine autonomy is not new. In 1950, British mathematician and computer scientist Alan Turing proposed what would later become known as the Turing Test—a method for determining whether a machine could exhibit intelligent behavior equivalent to, or indistinguishable from, that of a human. If a human evaluator cannot reliably distinguish between a machine and a human based on their responses to questions, the machine is said to have passed the test. While originally conceived as a philosophical benchmark, the test has taken on renewed relevance in light of modern AI advancements.
However, passing the Turing Test does not automatically confer moral or legal responsibility. As Huang points out, the real challenge lies not in mimicking human conversation but in navigating complex ethical landscapes and bearing the consequences of independent decision-making. This is where the distinction between weak and strong AI becomes critical.
Weak AI, by design, functions as a tool—an extension of human will rather than an independent agent. When a GPS navigation system fails to reroute around traffic, the fault lies with its developers or data providers, not the software itself. Similarly, when a facial recognition algorithm misidentifies an individual, liability typically falls on the company that deployed it. These systems operate within bounded environments and lack the capacity for self-directed learning or value-based reasoning.
Strong AI, however, represents a paradigm shift. Hypothetically, such a system could analyze vast datasets, infer patterns, adjust its behavior based on feedback, and even prioritize outcomes according to internalized objectives. Imagine an autonomous vehicle faced with an unavoidable accident scenario: should it protect its passenger at all costs, minimize overall harm, or follow traffic laws strictly? If the AI makes a choice that results in injury or death, who is responsible?
This dilemma is not purely theoretical. Incidents involving AI-related harm have already occurred. In 1978, a robotic arm in a Japanese motorcycle factory accidentally killed a worker by mistaking him for a metal – plate. This is the world’s first recorded robot – related fatality. More recently, autonomous vehicles have been involved in fatal crashes, raising urgent questions about liability. In these cases, current legal systems default to holding manufacturers, operators, or programmers accountable. But as AI systems gain greater autonomy, this model begins to falter.
Huang argues that applying third-party liability uniformly across all AI systems fails to account for the fundamental differences in their operational logic. Holding developers responsible for every action taken by a fully autonomous AI—especially one that evolves beyond its original code—would be both unjust and impractical. It risks discouraging innovation while placing undue burden on individuals who may no longer have control over the system’s behavior.
One alternative approach, known as the “reset and reprogram” solution, suggests that faulty AI can simply be shut down, debugged, and redeployed. While effective for rule-based systems, this method proves inadequate for strong AI, which learns from experience and adapts over time. Resetting such a system might erase recent errors, but it does not guarantee future compliance with ethical or legal standards. The knowledge and decision-making processes are distributed across neural networks, making them resistant to simple corrections.
Instead, Huang proposes a more radical solution: recognizing strong AI as a legal subject under strictly defined conditions. This does not imply full human-like rights, nor does it suggest that machines should vote or inherit property. Rather, it means creating a new category of legal entity—one analogous to corporate personhood, where organizations are treated as distinct actors capable of owning assets, entering contracts, and being sued.
The concept of legal personhood has evolved before. Corporations, despite being non-human entities, are granted certain rights and responsibilities under the law. They can be held liable for environmental damage, consumer fraud, or labor violations. The rationale is functional: without such recognition, it would be nearly impossible to enforce accountability in complex economic systems.
Extending this logic to AI, Huang suggests that strong artificial intelligence could be granted a form of limited legal personality. This would allow the system itself to bear responsibility for its autonomous actions, especially when those actions fall outside the scope of human intent or design. For example, if an AI financial advisor independently chooses to execute high-risk trades that result in client losses, the system—not just its creators—could be named in litigation.
Such a framework would require robust regulatory infrastructure. Huang emphasizes the need for a registration system, where advanced AI entities are certified, monitored, and assigned unique identifiers. Each decision made by the AI would be logged and traceable, enabling transparency and auditability. Moreover, these systems would operate within legally defined boundaries, much like corporations must adhere to charters and bylaws.
Crucially, this legal status would not absolve developers or operators of all responsibility. Human oversight would remain essential, particularly during deployment and maintenance phases. However, once an AI system demonstrates sufficient autonomy—defined through measurable criteria such as adaptive learning, contextual reasoning, and goal-directed behavior—it should be recognized as a distinct actor in the eyes of the law.
Critics may argue that attributing agency to machines undermines human dignity or introduces unnecessary complexity. After all, AI lacks consciousness, emotions, and subjective experience. But legal personhood has never been contingent on sentience. It is a pragmatic construct designed to facilitate justice and order in complex societies.
Moreover, failing to adapt the legal system to technological reality could lead to greater injustice. Consider a scenario where a medical diagnosis AI, trained on millions of patient records, recommends a treatment that leads to complications. If the AI continuously updated its model based on real-world outcomes—beyond the original training data—holding the hospital or software vendor solely responsible becomes increasingly tenuous. The AI, in effect, acted independently.
Huang’s proposal aligns with broader trends in global AI governance. In 2017, Saudi Arabia granted citizenship to Sophia, a humanoid robot developed by Hanson Robotics. While largely symbolic and criticized for lacking substantive legal rights, the gesture sparked international debate about the future of machine identity. The European Parliament has also discussed conferring “electronic personhood” on advanced robots, though no binding legislation has emerged.
What sets Huang’s analysis apart is its emphasis on gradation and limitation. She does not advocate for universal AI personhood but calls for a tiered approach based on capability. Weak AI remains a product, subject to product liability laws. Strong AI, when proven to operate autonomously, enters a new legal class—one that carries both rights and obligations.
Implementing such a system would demand interdisciplinary collaboration. Legal scholars must define thresholds for autonomy. Computer scientists must develop methods for verifying and auditing AI behavior. Ethicists must weigh the societal implications of delegating authority to non-human agents.
From a practical standpoint, insurance models could evolve to cover AI liability. Trust funds or liability pools might be established to compensate victims when an AI system causes harm. Regulatory bodies could mandate risk assessments before deploying high-autonomy systems in public domains such as transportation, healthcare, or law enforcement.
Public trust is another crucial factor. For people to accept AI as a legal actor, they must understand how decisions are made and have recourse when things go wrong. Explainability, fairness, and accountability must be embedded into the design of autonomous systems. Without transparency, legal recognition risks becoming a tool for corporate shielding rather than genuine accountability.
Huang also highlights the importance of cultural and philosophical context. In Western legal traditions, individual agency is central to responsibility. In contrast, some Eastern philosophies emphasize relational ethics and collective duty. Any global framework for AI personhood must navigate these differences, avoiding ethnocentric assumptions while promoting universal principles of justice.
As AI continues to permeate daily life—from managing smart homes to influencing judicial sentencing—the need for clear legal boundaries grows more urgent. The line between tool and agent is blurring. Machines are no longer passive recipients of commands; they are active participants in decision-making processes.
The path forward requires caution, but also courage. Just as the industrial revolution necessitated new labor laws, and the digital age brought about data protection regulations, the rise of autonomous AI demands a rethinking of legal personhood. Not because machines deserve rights in the abstract, but because humans deserve a system that reflects technological reality.
Granting limited legal status to strong AI is not about elevating machines to human status. It is about preserving fairness, ensuring accountability, and maintaining the integrity of the legal system in an age of intelligent machines. As Huang concludes, the goal is not to create artificial persons for their own sake, but to build a society where innovation and justice can coexist.
The conversation is still in its early stages. Legislators have yet to enact comprehensive AI liability laws. Courts have not ruled on cases involving truly autonomous systems. But the trajectory is clear: as AI grows smarter, the law must grow wiser.
